Highest Court of Justice

the highest Court of Justice or OGH is in Austria the highest instance in the punishing and civil proceedings.

Usually five judges ( simple senate) decide. In certain cases a three-senate decides. The strengthened senate consists of eleven judges andmeets above all if “going off the constant iurisdiction of the highest Court of Justice” (§ 8 OGHG) is necessary. A judge leads in each case the presidency.

The OGH decides in civil law things in third instance on revisions against judgements as well as appeals against resolutions, which the national courtsand higher regional courts as the second instance pleases have. In criminal actions it recognizes over pleas of nullity and appointments.

The OGH has its seat in Vienna (Law Courts) and became to 21. August 1848 as successors of the highest law place created of Maria Theresia 1749 production.
